Right of Withdrawal for Consumers

(A consumer is any natural person who concludes a legal transaction for purposes that are predominantly not attributable to their commercial or independent professional activity.)

Right of Withdrawal

You have the right to withdraw from this contract within one month without giving any reason. The withdrawal period is one month from the day,

• on which you or a third party named by you, who is not the carrier, took possession of the goods, provided that you ordered one or more goods as part of a single order and these are delivered uniformly;

• on which you or a third party named by you, who is not the carrier, took possession of the last good, provided that you ordered several goods as part of a single order and these were delivered separately;

• on which you or a third party named by you, who is not the carrier, took possession of the last partial delivery or the last item, provided that you ordered a good that is delivered in multiple partial deliveries or items.

To exercise your right of withdrawal, you must inform us (Project Acura GmbH, Kirchheimerstr. 44, 97271 Kleinrinderfeld, Phone Number: 09366 / 9827868, Email Address: [email protected]) by means of a clear declaration (e.g., a letter sent by post, fax, or email) of your decision to withdraw from this contract. You may use the attached model withdrawal form, but it is not mandatory.

You can also electronically fill out and submit the model withdrawal form or another clear declaration on our website (http://www.oz-orgonite.de/). If you make use of this option, we will immediately send you a confirmation of receipt of such a withdrawal (e.g., by email).

To meet the withdrawal deadline, it is sufficient that you send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we will reimburse you for all payments we have received from you, including delivery costs (with the exception of the additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we received the notice of your withdrawal from this contract. For this reimbursement, we will use the same means of payment that you used for the initial transaction unless expressly agreed otherwise with you; in no case will you be charged any fees for this reimbursement.

We may withhold reimbursement until we have received the goods back or you have provided evidence of having sent back the goods, whichever is the earliest.

You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you notify us of the withdrawal from this contract. The deadline is met if you send back the goods before the period of fourteen days has expired.

You will bear the direct costs of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

Exclusion or Early Expiry of the Right of Withdrawal

The right of withdrawal does not exist for contracts:

• for the delivery of goods that are not prefabricated and for the production of which an individual choice or decision by the consumer is decisive or which are clearly tailored to the personal needs of the consumer;
• for the delivery of goods that can spoil quickly or whose expiration date would quickly be exceeded;
• for the delivery of alcoholic beverages, the price of which was agreed upon at the conclusion of the contract, but which can be delivered no earlier than 30 days after the conclusion of the contract and whose current value depends on fluctuations in the market that cannot be influenced by the entrepreneur;
• for the delivery of newspapers, periodicals, or magazines with the exception of subscription contracts.

The right of withdrawal expires prematurely in the case of contracts:

• for the delivery of sealed goods that are not suitable for return due to health protection or hygiene reasons if their seal has been removed after delivery;
• for the delivery of goods that, after delivery, are inseparably mixed with other goods due to their nature;
• for the delivery of audio or video recordings or computer software in a sealed package if the seal was removed after delivery.
